1. What's in the SAFETEA-LU for Motorcycles?

I found a good copy of the final transportation bill on Thomas and
have broke out the sections pertaining to motorcycling in the bill to
send out to our legislative committee and others here at home and
thought it should be posted here also to help all understand what is
in this bill exactly. Two more sections in separate e-mails to follow.

SEC. 1914. MOTORCYCLIST ADVISORY COUNCIL.
(a) In General- The Secretary, acting through the Administrator of the
Federal Highway Administration, in consultation with the Committee on
Transportation and Infrastructure of the House of Representatives and
the Committee on Environment and Public Works of the Senate, shall
appoint a Motorcyclist Advisory Council to coordinate with and advise
the Administrator on infrastructure issues of concern to motorcyclists,
including--
(1) barrier design;
(2) road design, construction, and maintenance practices; and
(3) the architecture and implementation of intelligent transportation system
technologies.
(b) Composition- The Council shall consist of not more than 10 members
of the motorcycling community with professional expertise in national
motorcyclist safety advocacy, including--
(1) at least--
(A) one member recommended by a national motorcyclist association;
(B) one member recommended by a national motorcycle riders foundation;
(C) one representative of the National Association of State Motorcycle
Safety Administrators;
(D) two members of State motorcyclists' organizations;
(E) one member recommended by a national organization that represents
the builders of highway infrastructure;
(F) one member recommended by a national association that represents
the traffic safety systems industry; and
(G) one member of a national safety organization; and
(2) at least one, and not more than two, motorcyclists who are traffic
system design engineers or State transportation department officials.
SEC. 2010. MOTORCYCLIST SAFETY.
(a) Authority To Make Grants- Subject to the requirements of this
section, the Secretary
(b) Maintenance of Effort- No grant may be made to a State under this
section
in a fiscal year unless the State enters into such agreements with the
Secretary as the Secretary may require to ensure that the State will maintain its
aggregate expenditures from all the other sources for motorcyclist safety
training programs and motorcyclist awareness programs at or above the
average level of such expenditures in its 2 fiscal years preceding the date
of enactment of this Act.
(c) Allocation- The amount of a grant made to a State for a fiscal year under
this section may not be less than $100,000 and may not exceed 25 percent
of the amount apportioned to the State for fiscal year 2003 under section 402
of title 23, United States Code.
(d) Grant Eligibility-
(1) IN GENERAL- A State becomes eligible for a grant under this section by
adopting or demonstrating to the satisfaction of the Secretary--
(A) for the first fiscal year for which the State will receive a grant under this section,
at least 1 of the 6 criteria listed in paragraph (2); and
(B) for the second, third, and fourth fiscal years for which the State will receive a
grant under this section, at least 2 of the 6 criteria listed in paragraph (2).
(2) CRITERIA- The criteria for eligibility for a grant under this section are the following:
(A) MOTORCYCLE RIDER TRAINING COURSES- An effective motorcycle rider
training course that is offered throughout the State, provides a formal program
of instruction in accident avoidance and other safety-oriented operational skills
to motorcyclists and that may include innovative training opportunities to meet
unique regional needs.
(B) MOTORCYCLISTS AWARENESS PROGRAM- An effective statewide
program to enhance motorist awareness of the presence of motorcyclists
on or near roadways and safe driving practices that avoid injuries to motorcyclists.
(C) REDUCTION OF FATALITIES AND CRASHES INVOLVING MOTORCYCLES
- A reduction for the preceding calendar year in the number of motorcycle
fatalities and the rate of motor vehicle crashes involving motorcycles in the
State (expressed as a function of 10,000 motorcycle registrations).
(D) IMPAIRED DRIVING PROGRAM- Implementation of a statewide program
to reduce impaired driving, including specific measures to reduce impaired
motorcycle operation.
(E) REDUCTION OF FATALITIES AND ACCIDENTS INVOLVING
IMPAIRED MOTORCYCLISTS- A reduction for the preceding calendar
year in the number of fatalities and the rate of reported crashes involving
alcohol- or drug-impaired motorcycle operators (expressed as a function
of 10,000 motorcycle registrations).
(F) FEES COLLECTED FROM MOTORCYCLISTS- All fees collected
by the State from motorcyclists for the purposes of funding motorcycle
training and safety programs will be used for motorcycle training
and safety programs.
(e) Eligible Uses-
(1) IN GENERAL- A State may use funds from a grant under this
section only for motorcyclist safety training and motorcyclist
awareness programs, including--
(A) improvements to motorcyclist safety training curricula;
(B) improvements in program delivery of motorcycle training to both
urban and rural areas, including--
(i) procurement or repair of practice motorcycles;
(ii) instructional materials;
(iii) mobile training units; and
(iv) leasing or purchasing facilities for closed-course motorcycle skill training;
(C) measures designed to increase the recruitment or retention of
motorcyclist safety training instructors; and
(D) public awareness, public service announcements, and other
outreach programs to enhance driver awareness of motorcyclists,
such as the `share-the-road' safety messages developed under subsection (g).
(2) SUBALLOCATIONS OF FUNDS- An agency of a State that
receives a grant under this section may suballocate funds from
the grant to a nonprofit organization incorporated in that State to
carry out under this section.
(f) Definitions- In this section, the following definitions apply:
(1) MOTORCYCLIST SAFETY TRAINING- The term `motorcyclist
safety training' means a formal program of instruction that is
approved for use in a State by the designated State authority
having jurisdiction over motorcyclist safety issues, which may
include the State motorcycle safety administrator or a motorcycle
advisory council appointed by the Governor of the State.
(2) MOTORCYCLIST AWARENESS- The term `motorcyclist
awareness' means individual or collective awareness of--
(A) the presence of motorcycles on or near roadways; and
(B) safe driving practices that avoid injury to motorcyclists.
(3) MOTORCYCLIST AWARENESS PROGRAM- The term `motorcyclist
awareness program' means an informational or public awareness
program designed to enhance motorcyclist awareness that is
developed by or in coordination with the designated State authority
having jurisdiction over motorcyclist safety issues, which may include
the State motorcycle safety administrator or a motorcycle advisory
council appointed by the Governor of the State.
(4) STATE- The term `State' has the same meaning such term has
in section 101(a) of title 23, United States Code.
(g) Share-the-Road Model Language- Not later than 1 year after the
date of enactment of this Act, the Secretary, in consultation with the
Administrator of the National Highway Traffic Safety Administration,
shall develop and provide to the States model language for use in
traffic safety education courses, driver's manuals, and other driver's
training materials instructing the drivers of motor vehicles on the
importance of sharing the roads safely with motorcyclists.
SEC. 5511. MOTORCYCLE CRASH CAUSATION STUDY GRANTS.
(a) Grants- The Secretary shall provide grants to the
in-depth motorcycle crash causation study that employs the common
international methodology for in-depth motorcycle accident investigation
of the Organization for Economic Cooperation and Development.
(b) Funding- Of the amounts made available under section 5101(a)(1)
of this Act, $1,408,000 for each of fiscal years 2006 and 2007 shall be
available to carry out this section.

2. Oregon ROW that will make you go mmmm

Just received this from a friend in
of 14 women to the coast, the local Women in the Wind chapter out of
turnouts and passing lanes. It seems the group came upon a pickup
hauling a trailer of hay... doing 45 in a 55 zone. First sign of a passing
lane, the first group of the 14 moved to pass... the pickup, w/ 3 'cowboys'
inside, speeds up till the riders have to notch it up to 70-75 just to pass
before the lane runs out. This was done repeatedly until the last group
of three women were trying to pass (mind you, the truck continued to
slow to 45, then speed up at the passing lane).. now they're doing 80
just to pass, as they're committed (and w/ the trailer, there's no way to
get back behind the truck in time) as the lane is running out and an
oncoming car approaches from around the bend. The two women
managed to slip in front of the pickup in time, but the third couldn't,
had to make a sharp jump back into the lane to avoid a head-on, lost
control (most likely on road gravel after some investigation) and lost it
on the shoulder/embankment. Landed face down w/ her brand new
bike on top of her (after the bike did an end-over). Miraculously, no
broken bones or road rash (had helmet, leathers).
The pick-up finally managed to pull over quite a ways up the road, but
told the cops that the women were passing illegally.

Now I'm angry . I just found the Oregon State Police accident notice from
the
4:04 pm - Rollover accident on Highway 42 at Milepost 63 in Tenmile. Driver
was cited for unsafe passing and was treated and released for minor injuries
at
trying to make a pass in a 2005 Harley Davidson and flipped the vehicle.
This stinks .

Michael Fleming, amateur inventor and full-time
a patent application for a new safety device for kids.
It's called the Automobile Helmet. "The time has come for a helmet that
protects children in autos," Mr. Fleming said.
Actually the time is overdue.
"Too many children are killed in car crashes from head injuries and too
many who survive face a future filled with head injuries," Mr. Fleming
said, citing government statistics that 2,500 children are killed and
294,000 injured annually in vehicle accidents.
"A protective helmet must be produced to confront this problem," he said.
But being produced and being worn are two different things.
Based on age and weight, kids move from infant to child safety to booster
seats, which are required by law until age 8.
"But once they reach school age at 5 or 6, they resist booster seats," said
John Ulczycki, director of the Transportation Safety Group for the National
Safety Council.
And how do parents who refuse to use seats belts persuade kids to not only
belt up, but helmet up as well?
Mr. Fleming thinks he has the answer: loading the helmet with electronics.
"By building a helmet that allows a child to listen to music, watch a DVD
movie or play a handheld game, I'm hoping they'll want to wear a helmet
without complaint," Mr. Fleming said.

injured Sunday when one of the vehicles hit her.
The accident happened west of
intersection of
Michigan State Police in
Trammell Toombs of
Police say Larsen was trying to slow down the group of motorcycles that was
passing by her home. She went into the road carrying a pitchfork before being
hit.
The driver of the motorcycle and the woman were taken to
motorcycle driver is in stable condition.
The incident is still under investigation.

2. IF IT QUACKS LIKE A DUCK...(gun grabbers)
IF IT QUACKS LIKE A DUCK...
The Capitol Hill newspaper, Roll Call, reported on May 2, on an upstart "centrist" advocacy (read: lobbying) group known as "Third Way." The group's co-founders, Matt Bennett, Jonathan Cowan, and Jim Kessler should be familiar to readers of the Grassroots Alert. All previously worked for "Americans For Gun Safety" (AGS), an organization that was founded in 2000 under the guise that it too would be a "centrist" group on gun issues.
A little more background on each may give those who believe they are centrists a bit of pause (at least on gun issues). Matt Bennett was a former Clinton White House aide. Former AGS President Jonathan Cowan served as former Clinton HUD Secretary Andrew Cuomo's right hand man when the secretary was actively promoting lawsuits against the gun industry. Conspicuous on Jim Kessler's resume was a stint as Senator Chuck Schumer's (D-N.Y.) gun adviser. Hardly "centrist" credentials. (AGS's founder, Monster.com founder and billionaire Andrew McKelvey is a former board member of HCI [now the Brady Center], who apparently became disillusioned with the ineffectiveness of HCI and thus formed AGS.)
Of course, the facade that AGS was somehow moderate was quickly shattered. The group supports an extension of the Clinton gun ban and legislation that would end gun shows as we know them. And according to materials distributed at an early AGS organizational meeting, its "top national priority" is "passage of licensing and/or registration..."--a position, to our knowledge, it has yet to repudiate.
AGS has also worked through the years to expand its base by affiliating not with "centrist" groups, but with radical anti-gun groups at the state and local levels. In fact, many of the groups that affiliated with AGS are longtime HCI affiliates: "Remove any guns from your home" (Women Against Gun Violence); "The second amendment of the United States Constitution has nothing to do whatsoever with personal use of firearms" (Citizens of Arizona to Prevent Gun Violence); and "The best way to protect your family is not to keep a gun in the home" (Iowans for the Prevention of Gun Violence).
Then, on May 4, Third Way's VP for Public Affairs, Matt Bennett, wrote a letter to the editors at Roll Call to set the record straight, noting in fact, the group doesn't profess to be a centrist organization. Bennett's letter states, "...Third Way is a nonpartisan advocacy group. Our mission is to promote and strengthen the progressive cause..."
Those who choose to align themselves with Third Way should bear in mind the co-founders' previous place of employment before turning to them for assistance with issues relating to our Right to Keep and Bear Arms.

ACLU Calls "Gang Bill" a Misguided Criminal Justice Reform Attempt; Measure
Would Harm Youth, Expand Death Penalty

WASHINGTON - As a key House panel today considered legislation dealing with
gang violence, the American Civil Liberties Union renewed its opposition to
the direction this measure is taking, citing concerns over the bill's
expansion of federal death penalty provisions and the detrimental impact it
would have on young people.
"We have a capital punishment system that is already known to be broken; we
should not seek to expand it," said Jesselyn McCurdy, an ACLU Legislative
Counsel. "Addressing gang crime is very important to maintaining public
safety. But this measure ultimately fails to honor basic ideals of fairness
in our criminal justice system. Congress must reject this misguided
legislation."
Juvenile justice, criminal justice and capital punishment watchdog groups
have criticized H.R. 1279, the Gang Deterrence and Community Protection Act
of 2005. A similar bill was introduced last year, but died in the Senate.
At a time when many are calling for a thorough review of the capital
punishment system, the bill would actually expand the federal death penalty.
The bill makes capital punishment an option in a wide range of cases,
running counter to the Supreme Court's requirement that the death penalty be
limited to the "worst of the worst."
The legislation also includes various mandatory minimums sentences for a
broad category of offenses that are labeled "gang crimes." Under this bill,
the mandatory minimum sentences for these crimes will range from five to 30
years. "We already know the discriminatory effect of mandatory minimums when
in 1999, 77 percent of the individuals receiving mandatory sentences where
African American and Latino," McCurdy said.
The ACLU also objected to the bill's provisions that would shift more
juveniles into the federal criminal system, saying that the federal system
does not have the resources to deal with young people appropriately.
Additionally, studies have conclusively shown that placing youth in the
adult criminal justice system does nothing to reduce crime and, worse still,
has the opposite effect.
"The gang bill goes well beyond the scope of gangs," McCurdy said. "And, it
first place. Congress should look for real solutions, rather than tossing
young people into the criminal justice system to serve long sentences and
expanding a flawed capital punishment system."

Bills affecting motorcycling:
SB993 Senator Jim Holt (R) (Springdale), et al "Additional Penalties for Violations of the Rules of the Road That Involve the Failure to Yield to the Right-of-Way". The bill was amended for a second time and again returned to the Senate Body where it passed by a unanimous vote. It has been transmitted to the House and the Committee on Public Transportation-House.
HB2833 introduced by Representative Mark Pate (D) (Bald Knob), will ...Allow the Drivers of Motorcycles to Proceed Through an Intersection Controlled by a Traffic-Control Device Under Limited Circumstances". This bill passed the House and was sent to the Senate Committee on Public Transportation where it received a Do Pass recommendation. It passed the Senate and was returned to the House where it was transmitted to the Governor for his signature.
HB2086 Booker T. Clemons (D) (Pine Bluff) "Eric;'s Law: The Nitrous Oxide Prohibition Act". This bill states that "Nitrous Oxide Shall Not Be Used in any Motor Vehicle or Motorcycle Driven on Streets or Highways; To Make the Use of Nitrous Oxide in a Motor Vehicle or Motorcycle that is Driven in a Race on the Streets or Highways an Additional Offense (Class C Misdemeanor). After passage by the House it was sent to the Senate Committee on Public Transportation. The bill passed the Senate and returned to the House as passed as amended. Senate amendments #1 and #3 were read and concurred in. It was transmitted to the Governor's Office where it was signed and HB2086 became Act 1569.
SB457, Isaac's Law," Introduced by Senator Broadway (D) Bryant) which increases penalties for passing a stopped school bus by motor vehicles and motorcycles. Amended, passed from the Senate and referred to the Committee on Judiciary Committee-House. It has been returned by the Committee Do Pass.
HB2788 "An Act to Prescribe Limitations for Young Children on Motorcycles," Representative Jay Bradford (D) (Pine Bluff). Referred to the Committee on Public Transportation-House, this bill prohibits children under eight years of age to ride on a motorcycle as a passenger except in a parade. It passed the House and was transmitted to the Senate Committee on Public Health, Welfare and Labor where it was returned by the Committee with the recommendation that it Do Pass.
Bills affecting transportation:
SB52 sponsored by Senator Jimmy Jeffress will "...Prohibit the use of Automated Enforcement Devices to Enforce Traffic Laws Except in Limited Circumstances". After four amendments the bill passed the Senate and was transmitted to the House passed the House and returned to the Senate. It was delivered to the Governor who signed it and SB52 became Act 1451.

Dear Senator Bowen:
Thank you for introducing SB 1021. ABATE of California is a motorcycle rights organization which represents motorcyclists from every county in the state, with over 40 active Locals. ABATE is dedicated to serving the motorcyclists of California in a variety of ways, including the promotion of motorcycle safety. The biggest component of motorcycle safety is increasing public awareness of motorcycles and encouraging drivers to look for motorcycles. As you are aware, a significant percentage of injuries and deaths occur as a result of right-of-way violations. To date, the penalties for such infractions have been minimal and have not been representative of the severity of the offense. ABATE is appreciative of any legislative effort which will aid in reminding the motoring public to look out for bikers. SB 1021 increases both the fine and the penalty for right-of-way violations and this should result in increased attention on the part of the motoring public. We support SB 1021 and thank you for your efforts on behalf of the motorcyclists of California.

3. Tennessee Legislative Update

Hello All
Today is April 5th, 2005 and we had bills in the Full Transportation Committee today.
HB 456 helmet Bill 21 and older with a $10,000.00 insurance policy passed out of the Transportation Committee and we are going to the Finance Ways and Means we will be needing anything we can round up on passing the law will bring more money into the state thru registrations, Tourism ( this is the biggest assets we can get) we need all info we can get so I can do another presentation for John to give them next week.
HB 1242 Handle Bar Height requirement to be dropped will be going to Calendar Rules to be put on the House Floor for a vote.
HB 924 The Parade Bill had a amendment added that would let anyone who has a state residence where they have Freedom of Choice they can ride here In Tennessee without a helmet too. This bill was rolled 1 week in The Safety Sub of Transportation Committee more to come on it next week.

4. West Virginia Legislative Update
Due to a power struggle between the Senate President, and our new Governor, it looks like the Helmet bill is, stick a fork in it done, for this year, but it will carry over to next year. The Governor stuck to his guns, but the senate president has a little more juice than the governor first thought. The session is coming down to the wire. Wednesday April 13th the House Judiciary committee meets. Danny's Law is on the calendar to be considered for passage to the House Floor. Not a lot of time after that. The session ends Midnight April 9th. We think we have our "DUCKS in a ROW", pardon the double pun. But it couldn't hurt for Delegates to hear intelligent arguments in favor of Danny's Law.
